1. About Setwork

Setwork is a practice management tool designed for psychedelic-assisted therapy facilitators. It provides tools to manage client intake forms, collect and store session preparation responses, and organize client information. Setwork is not a medical device, a clinical platform, or a licensed healthcare service.

2. Acceptable Use

Setwork is intended for use by trained and/or licensed facilitators operating within the applicable legal framework of their jurisdiction. By creating an account, you represent that:

  • You are a qualified facilitator, therapist, or practitioner authorized to conduct the sessions for which you are collecting client data.
  • You will use Setwork only for lawful purposes and in compliance with all applicable local, provincial, state, and federal laws.
  • You will not use Setwork to collect data on behalf of clients in jurisdictions where the underlying practice is prohibited by law.
  • You will obtain appropriate informed consent from clients before collecting their personal information through Setwork.

We reserve the right to suspend or terminate accounts that we reasonably believe are being used in violation of these terms or applicable law.

3. No Medical Advice

Setwork does not provide medical advice, diagnosis, treatment recommendations, or clinical decision support. The intake forms, question templates, and screening tools provided within Setwork are informational resources only and do not constitute clinical guidance.

You are solely responsible for all clinical decisions made in connection with your practice. Nothing in Setwork should be interpreted as a substitute for professional medical judgment or supervision.

4. Data Storage and Confidentiality

Client form responses and facilitator account information are stored securely using Supabase, a cloud database provider. Data is encrypted at rest and in transit. Setwork does not sell, share, or disclose client data to any third party except as required by law.

As the facilitator, you are responsible for maintaining the confidentiality of data collected through your account. You should not share your login credentials and should take reasonable steps to prevent unauthorized access to client information.

5. Facilitator Responsibility

You are solely responsible for:

  • Your own compliance with all professional, ethical, and legal obligations governing your practice.
  • Obtaining informed consent from clients before using Setwork to collect their information.
  • The accuracy and completeness of any information you enter or configure within Setwork.
  • Ensuring that client data collected through Setwork is handled in accordance with applicable privacy laws (including PIPEDA, GDPR, HIPAA, or other relevant regulations).
  • Your own data backup and retention obligations under your professional or regulatory requirements.

Setwork is a tool to support your practice — it does not replace your professional obligations or judgment.

6. Intellectual Property

The Setwork platform, including its design, code, and content, is the property of Setwork and is protected by applicable intellectual property laws. You may not copy, modify, distribute, or reverse-engineer any part of the platform without our written permission.

You retain ownership of the data you and your clients enter into Setwork.

7. Limitation of Liability

To the maximum extent permitted by applicable law, Setwork and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the platform, including but not limited to:

  • Loss of client data due to technical failure.
  • Regulatory or professional consequences resulting from your use of Setwork.
  • Any harm arising from clinical decisions informed by information collected through Setwork.

Our total liability to you for any claim arising from use of Setwork shall not exceed the amount you paid to us in the twelve months preceding the claim, or $100 CAD, whichever is greater.

8. Service Availability

We aim to keep Setwork available and reliable, but we do not guarantee uninterrupted access. We may perform maintenance, updates, or make changes to the platform at any time. We will make reasonable efforts to notify users of significant changes or downtime where possible.

9. Changes to These Terms

We may update these Terms of Service from time to time. When we do, we will update the "Last updated" date at the top of this page. Continued use of Setwork after changes are posted constitutes your acceptance of the revised terms. If you disagree with updated terms, you may close your account at any time.
